Restraining Orders

If you are in fear for yourself and/or your children and have already called your local police for help, call the Foothill Law Group as soon as possible! You may be able to obtain a Domestic Violence Restraining Order (DVRO) that can offer you and your children protection.


DVRO’s can be filed against a current or former spouse, a current or former boyfriend or girlfriend, someone you lived with, or someone you are related to either through blood or marriage, if they do any of these actions:

  • Either harms or attempts to physically harm you or your children;

  • Sexually assaults you;

  • Verbal or physical threats via phone calls, text messages, emails, etc;

  • Strikes you, stalks you, battery of force of any kind against you;

  • Destruction of your property;

  • Makes you fear that you are in danger

According to LAPD, an order may be obtained to:


  • Direct the attacker to leave the household;

  • Prevent the attacker from entering the residence, school, business, or place of employment of the victim;

  • Award the victim or other parent custody of, visitation with, a minor child or children;

  • Restrain the attacker from molesting or interfering with minor children in the custody of the victim;

  • Direct the party not granted custody to pay support of minor children, if that party has a legal obligation to do so;

  • Direct the defendant to make specified debit payments coming due while the order is in effect; and/or

  • Direct that either or both parties participate in counseling

What are your restraining order options?

Emergency Protective Order (EPO) – An Emergency Protective Order can be issued by the police if it is determined that you are in immediate danger and is effective immediately. This type of restraining order however can only last for 5 business days or 7 calendar days, and is a bridge as we work towards a more long term resolution.

Ex Parte Restraining Order (EPRO) – As you are awaiting a DVRO hearing, an Ex Parte Restraining Order will continue your protection until the hearing is scheduled. This will order the abuser to leave the home and have no further contact with you in any form until the hearing.

Domestic Violence Restraining Order (DVRO) – At the hearing, a judge can grant you a Domestic Violence Restraining Order for as long as 5 years. If there is no termination date scheduled on the restraining order then it is valid for 3 years.
